Terms of Service

These terms govern your use of cribskenya.com and the management and listings platforms we operate on our subdomains (together, the "services"). By creating an account or using the services you accept them. If you do not accept them, do not use the services.

If you accept these terms on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” means that organisation.

One account gives you access to both the management platform and the listings marketplace. Creating a second account does not create a separate contract, and we may refuse or close duplicate accounts.

You must be at least 18 years old and able to enter a binding contract. If you use the services for an organisation, you confirm you are authorised to act for it.

You are responsible for keeping your credentials confidential and for everything done under your account. Tell us promptly at the contact address below if you suspect unauthorised use.

We may suspend or close an account where we reasonably believe it has been compromised, is being used unlawfully, or where you have breached these terms. Where a suspension is temporary and the risk has been resolved, we will restore it.

You keep all rights in the property details, photographs, documents and other content you upload. You grant us a licence to host, store, process, reproduce and display that content only as needed to operate the services for you — for example to show a listing to prospective tenants or to keep an auditable record of a payment.

You confirm you have the right to upload what you upload, and that doing so does not infringe anyone else's rights or break the law.

You can export or delete your content at any time. Deleting an account does not remove records we must keep for legal reasons; see the privacy policy for retention periods.

You must not use the services to post unlawful or misleading content, to infringe intellectual property, to list property you do not have the right to rent out, to impersonate anyone, to scrape or reverse-engineer the services, to attack or overload our infrastructure, to circumvent usage limits, or to distribute malware.

Listings must describe real, available property. Photos must be of the property being advertised. We may remove content that breaches this section and may close the account that posted it.

Paid plans are billed in advance. The unit limits and features for each plan are published on our pricing page and may change; we will give notice before a change affects you.

Changing plan changes your feature set and unit limit. Your properties, payments, receipts, maintenance history and utility logs are never deleted or reset by a plan change. If a downgrade would put you over the new unit limit, we will tell you before it takes effect.

Fees are exclusive of taxes and duties, which you are responsible for. We may change prices on renewal with reasonable notice. We refund a cancelled subscription on a pro-rata basis for the unused period, less any amount owed.

The services link to third parties, including payment processors. Your use of those services is governed by their own terms, not these. We do not control and are not responsible for third-party content or availability.

We own the services, including the software, design, text, trademarks and logos. These terms grant you a limited, revocable, non-transferable licence to use the services as intended. Nothing else transfers any right.

If you send us suggestions or feedback, you allow us to use it without restriction or payment, though we will not identify you as its source without permission.

The services are provided on an as-is and as-available basis. We do not guarantee uninterrupted access. We may modify, suspend or discontinue features, with notice where practical. We do not guarantee that a listing will result in a tenancy, or that rent will be collected on time.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Our total liability to you for any claim arising out of or relating to the services is limited to the fees you paid us in the twelve months before the claim.

We are not liable for indirect or consequential loss, including lost profit, lost rent, lost data or business interruption. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

You agree to indemnify us against claims arising from your content, your use of the services in breach of these terms, or your breach of anyone else's rights.

These terms apply while you use the services. You may stop at any time by closing your account. We may terminate for breach as described above. On termination, your content stops being published and we handle retained data as set out in the privacy policy. Sections that by their nature should survive termination do survive it.

We may update these terms. For a material change we will notify account holders by email or in-product notice at least 30 days before it takes effect. If you continue using the services after that date, the updated terms apply. If you disagree, you may close your account.

These terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction. Before starting proceedings, please raise the problem with us at the contact address below and give us a reasonable opportunity to resolve it.

If a provision is found unenforceable, the rest still applies. Failing to enforce a provision is not a waiver of it. These terms are the entire agreement between you and us on their subject and supersede any earlier statement, except a fraud claim. You may not assign these terms without our written consent; we may assign them on notice to you as part of a reorganisation or sale.
